Welcome to GetSmartWP (the “Site”, “Service”, “we”, “us”, or “our”), available at https://getsmartwp.com. GetSmartWP is an online digital store that sells WordPress themes and WordPress plugins to customers worldwide.

These Terms of Service (“Terms”) form a legally binding agreement between you (“you”, “User”, “Customer”) and GetSmartWP. By accessing, browsing, registering an account, or purchasing any product from our Site, you agree to be bound by these Terms and our Privacy Policy.

If you do not agree with any part of these Terms, please do not use our Service.

1. Definitions

  • “Product(s)” – Any WordPress theme, plugin, or related digital item sold on the Site.
  • “License” – The limited right granted to you to use a Product under the conditions described in Section 5.
  • “Account” – The user profile you create on the Site to access purchases, licenses, updates, and support.
  • “Order” – A confirmed purchase transaction of one or more Products.

2. Eligibility

To use the Service and make purchases, you must:

  • Be at least 18 years old, or the age of majority in your jurisdiction.
  • Have the legal capacity to enter into a binding contract.
  • Provide accurate, current, and complete information during registration and checkout.
  • Not be prohibited from using the Service under any applicable laws or sanctions.

If you are using the Service on behalf of a company or organization, you represent that you have the authority to bind that entity to these Terms.

3. Account Registration

To purchase Products and access licenses/updates, you must create an account.

3.1 Your Responsibilities

  • You are responsible for maintaining the confidentiality of your login credentials.
  • You are responsible for all activities that occur under your Account.
  • You must notify us immediately at hello@getsmartwp.com if you suspect any unauthorized use of your Account.

3.2 Account Termination

We reserve the right to suspend or terminate your Account, without notice, if we reasonably believe you have:

  • Violated these Terms
  • Engaged in fraudulent activity
  • Abused your license key, our update servers, or our support channels
  • Misused our trademarks or brand in a way that violates Section 9 of these Terms

4. Products and Pricing

4.1 Product Description

We make every effort to describe our Products (features, compatibility, screenshots, demos) as accurately as possible. However, we do not warrant that product descriptions, visuals, or availability are error-free.

4.2 Pricing

  • All prices are listed in USD (United States Dollars), unless otherwise stated.
  • Prices may change at any time without prior notice. Changes will not apply to Orders already completed.
  • Applicable taxes (VAT, GST, sales tax) may be added at checkout based on your billing location.

4.3 Currency Conversion

If you pay in a currency other than USD, your bank or payment provider may apply currency conversion fees. We are not responsible for these charges.

5. License Terms

When you purchase a Product, you are granted a non-exclusive, non-transferable, worldwide license to use the Product under the conditions below.

5.1 Source-Code License

The source code of our Products is licensed under the GNU General Public License v2 or later (GPL). Under the GPL, you may install, use, modify, and redistribute the source code on as many sites as you wish (see Section 9.2 for the full IP terms).

5.2 Paid License: Updates and Support

What you actually purchase when you buy a Product from us is a personal, non-transferable entitlement to:

  • Automatic updates from our update servers, and
  • Technical support through our official channels,

for a defined number of sites and for 1 (one) year from the date of purchase (see Section 6).

Products may be offered in different license tiers (variants), each specifying a different number of sites entitled to receive updates and support. The exact entitlements of each tier are clearly displayed on the Product’s sales page at the time of purchase.

Common license tiers include (but are not limited to):

a. Single Site License

  • Updates and support for one (1) live website registered to your Account.

b. Developer / Multi-Site License

  • Updates and support for the number of sites specified in the tier (for example, 3, 5, or 25 sites).

c. Unlimited / Agency License

  • Updates and support for an unlimited number of sites that you own or manage for yourself or your clients.

After the 1-year period expires, you may continue to use the version of the Product you have under the GPL, but you will no longer receive updates or support unless the license is renewed.

5.3 What You May NOT Do

Because your paid license is a service entitlement (not a restriction on the GPL code itself), the following are not permitted:

  • Sharing your license key with third parties, posting it publicly, or enabling others to receive updates or support using your license.
  • Using a single-site license to register updates for more sites than the tier allows.
  • Misrepresenting a modified or third-party copy as an official GetSmartWP Product (see Section 9.3 on trademarks).
  • Claiming to provide “official updates” or “official support” for our Products.
  • Automated scraping, mirroring, or republishing of our update servers, download endpoints, or customer dashboard.

These restrictions apply to our trademarks, brand, and paid services — not to the GPL source code, which remains freely usable, modifiable, and redistributable in accordance with the GPL.

5.4 License Keys

Your license key is tied to your Account and the site URL(s) you activate. We may deactivate license keys that are shared, abused, or used beyond the paid scope without affecting your separate rights in the GPL source code.

6. Updates and Support

6.1 Updates

  • Access to Product updates is included for 1 (one) year from the date of purchase for every license tier.
  • After the 1-year license period expires, you may continue to use the version of the Product you have, but you will no longer receive updates or security patches unless you renew your license.
  • Renewal pricing may differ from the original purchase price and will be clearly displayed before checkout.

6.2 Support

Support is provided through the following channels:

  • Contact Form — available on our Contact page
  • Documentation — comprehensive self-service guides at our documentation portal
  • Ticket System — coming soon
  • YouTube Channel — video tutorials, coming soon

Support covers:

  • Installation and activation issues
  • Bug reports and defect fixes
  • Basic usage questions and feature clarifications
  • Guidance on how to use documented features

Support does NOT cover:

  • Custom development, design, or bespoke feature requests
  • Third-party plugin, theme, or custom code conflicts
  • Server-level debugging, hosting configuration, or DNS issues
  • Modifications you have made to our Product’s source code
  • Training on WordPress, PHP, CSS, or general web development

Support response times are best-effort; we aim to respond within 1–3 business days (Monday–Friday, excluding public holidays).

7. Payment Terms

7.1 Accepted Payment Methods

We currently accept payments via:

  • PayPal
  • Stripe (integration in progress)

Additional payment methods may be added in the future.

7.2 Order Confirmation

Your Order is confirmed only after the payment has been successfully processed by the payment gateway. You will receive a confirmation email containing your receipt, download link(s), and license key.

7.3 Failed Transactions

If a payment fails, no Products will be delivered. You may retry the transaction or contact us for assistance.

7.4 Fraud Prevention

We reserve the right to cancel any Order we suspect to be fraudulent, chargeback-risky, or non-compliant with payment provider policies.

8. Refund Policy

We offer a No-Questions-Asked 14-Day Money-Back Guarantee for our Products. This section is a short summary; the full and authoritative version is our dedicated Refund Policy, which forms part of these Terms.

8.1 The 14-Day Guarantee

You may request a full refund within 14 (fourteen) calendar days from the date of your original purchase, for any reason. You are not required to justify your decision.

8.2 Limits of the Guarantee

To keep this generous policy sustainable, the following limits apply:

  • Requests submitted after the 14-day window are not eligible.
  • License renewals (annual updates & support extensions) are non-refundable once processed.
  • Repeated refund abuse — such as buying-and-refunding the same or similar Products multiple times, or mass-refunding after extracting the code/assets — may result in a denied refund, account suspension, and a ban from future purchases.
  • Evidence of piracy, license-key sharing, or unauthorized redistribution of your license will cause an immediate denial and may lead to legal action.
  • Chargebacks filed without contacting us first waive your right to a refund under this policy.

8.3 How to Request a Refund

Send an email to hello@getsmartwp.com with:

  • Your Order ID
  • The registered email address used for the purchase
  • (Optional) A short reason, to help us improve

We will review and communicate a decision within 1–5 business days. Approved refunds are initiated on our side within another 1–5 business days to the original payment method. The actual time for the funds to appear in your account depends on your bank or card issuer.

8.4 After a Refund

Once a refund is granted:

  • Your license key will be deactivated — you will lose access to automatic updates and technical support for that Product.
  • You are asked, in good faith, to uninstall and remove the Product from your websites.
  • You may not use the GetSmartWP name, logo, or brand to present the refunded Product as “official” in any way (see Section 9).
  • Re-activating or fraudulently continuing to use your refunded license key is considered a misuse of our licensing system and a breach of these Terms.

9. Intellectual Property

9.1 Our Content

All content on the Site — including text, graphics, logos, icons, images, source code, themes, plugins, documentation, and the overall design — is the property of GetSmartWP or its licensors and is protected by international copyright and trademark laws.

9.2 GPL License for Our Products

Our Products — including their PHP source code, HTML templates, CSS, JavaScript, images, icons, fonts, and other bundled assets — are licensed under the GNU General Public License v2 or later (GPL), consistent with the licensing of WordPress itself.

Under the GPL, you are free to:

  • Use the Product on any number of websites you own or manage.
  • Study, modify, and adapt the source code to your needs.
  • Redistribute the source code and your modifications, provided you do so under the same GPL license and keep the copyright notices intact.

The following elements are not part of the GPL grant and remain protected separately:

  • The GetSmartWP name, logo, trademarks, and brand identity (see Section 9.3).
  • Your license key, which is a personal access credential granting you automatic updates and technical support (see Section 9.4).
  • Our services and infrastructure — including our update servers, customer dashboard, and support channels.

9.3 Trademark and Brand Protection

“GetSmartWP”, the GetSmartWP logo, product names, slogans, visual identity, and any other brand assets are trademarks of GetSmartWP, whether registered or not. Trademark law is separate from copyright and is not waived by the GPL. You may NOT:

  • Use the GetSmartWP name, logo, or any confusingly similar mark to promote, sell, or distribute any product or service.
  • Re-brand, rename, or “white-label” a modified copy of our Product using our original name or branding in a way that suggests it is the official release.
  • Imply any affiliation, sponsorship, partnership, or endorsement by GetSmartWP without our prior written consent.
  • Use our brand in domain names, social media handles, app names, or marketplace listings in a way that causes confusion with our official presence.

If you redistribute a modified copy of our GPL-licensed Product, you must remove or change the GetSmartWP name, logo, and branding before distribution. The underlying GPL code may be redistributed; our brand may not.

9.4 License Keys, Updates, and Support

While the source code of our Products is GPL-licensed and freely redistributable, the following are personal services tied to your paid license and are not transferable without our written consent:

  • Access to automatic updates from our update servers.
  • Access to technical support through our support channels.
  • Use of your license key to authenticate with our services.

You may NOT:

  • Share your license key with third parties, post it publicly, or enable others to receive updates or support using your license.
  • Claim to provide “official updates” or “official support” for GetSmartWP Products.
  • Represent any forked, modified, or redistributed copy as the “official” GetSmartWP Product.
  • Use automated means to scrape, mirror, or republish our update servers, download endpoints, or customer dashboard.

Misuse of a license key may result in the immediate suspension of that key and the associated account, and may lead to legal action under trademark, unfair competition, or computer-misuse laws, without affecting the separate GPL rights you have in the source code itself.

9.5 User Content

By submitting reviews, comments, testimonials, or any content to the Site, you grant us a worldwide, royalty-free, non-exclusive license to use, display, reproduce, and distribute that content in connection with the Service.

10. Acceptable Use

You agree not to:

  • Use the Service for any unlawful or harmful purpose.
  • Attempt to gain unauthorized access to our servers, databases, or other users’ accounts.
  • Interfere with, disrupt, or compromise the integrity or security of the Service.
  • Use automated tools (bots, scrapers, crawlers) in a way that degrades the Site’s performance.
  • Upload viruses, malware, or malicious code.
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
  • Harass, abuse, or harm other users or our staff.

Violations may result in immediate account termination and legal action.

11. Disclaimers

11.1 “As Is” Basis

The Service and all Products are provided on an “AS IS” and “AS AVAILABLE” basis, without warranties of any kind, whether express or implied, including but not limited to:

  • Merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Error-free or uninterrupted operation

11.2 No Guarantee of Compatibility

While we strive to make our Products compatible with the latest WordPress version and popular plugins/themes, we cannot guarantee compatibility with every third-party product, custom server configuration, or hosting environment.

11.3 Your Responsibility

You are responsible for:

  • Backing up your WordPress site before installing or updating any Product.
  • Testing Products in a staging environment when appropriate.
  • Complying with any third-party license terms relevant to your use.

12. Limitation of Liability

To the maximum extent permitted by law, GetSmartWP and its affiliates, employees, and agents shall not be liable for:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, or business opportunities
  • Damage caused by your use or inability to use the Service or Products
  • Damage caused by third-party services (hosting, payment, plugins, etc.)
  • Site downtime, data loss, or security breaches beyond our reasonable control

In any case, our total aggregate liability shall not exceed the amount you paid to us for the Product giving rise to the claim in the 12 months preceding the event.

Some jurisdictions do not allow certain liability limitations, so some of the above may not apply to you.

13. Indemnification

You agree to indemnify, defend, and hold harmless GetSmartWP, its owners, affiliates, and employees from any claims, damages, liabilities, losses, or expenses (including reasonable legal fees) arising from:

  • Your use or misuse of the Service or Products
  • Your violation of these Terms
  • Your violation of any rights of a third party (including intellectual property rights)
  • Any content you submit to the Site

14. Third-Party Services

The Site may integrate with or link to third-party services (payment processors, hosting providers, analytics tools, etc.). We are not responsible for the content, policies, or practices of those services. Your use of third-party services is governed by their own terms and privacy policies.

15. Modifications to the Service and Terms

15.1 Changes to the Service

We reserve the right to modify, suspend, or discontinue any part of the Service (including Products) at any time, with or without notice. We are not liable to you or any third party for any such modification or discontinuation.

15.2 Changes to These Terms

We may update these Terms from time to time. The “Last Updated” date will reflect the most recent revision. Material changes will be communicated via email or a site notice. Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms.

16. Termination

We may terminate or suspend your access to the Service at any time, without prior notice, for conduct that:

  • Violates these Terms
  • Is harmful to other users, us, or any third party
  • Is illegal or fraudulent

Upon termination, your right to use the Service and any Products will immediately cease. Sections relating to intellectual property, disclaimers, limitation of liability, indemnification, and governing law shall survive termination.

17. Governing Law and Dispute Resolution

17.1 Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of Indonesia, without regard to its conflict-of-law principles.

17.2 Dispute Resolution

In case of any dispute:

  1. Informal Resolution – Please first contact us at hello@getsmartwp.com so we can try to resolve the matter amicably.
  2. Mediation/Arbitration – If informal resolution fails, disputes shall be resolved through mediation or arbitration in West Java, Indonesia, unless otherwise required by applicable consumer protection laws in your jurisdiction.
  3. Court – Any remaining disputes shall be submitted to the exclusive jurisdiction of the competent courts located in West Java, Indonesia.

18. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.

19. Entire Agreement

These Terms, together with the Privacy Policy and any other legal notices published on the Site, constitute the entire agreement between you and GetSmartWP regarding the use of the Service, and supersede any prior agreements.
