End User License Agreement (EULA)

This End User License Agreement (the “Agreement” or “License”) is a legally binding contract between you (“you”, “User”, “Licensee”, “Customer”) and GetSmartWP (“we”, “us”, “our”, “Licensor”), available at https://getsmartwp.com.
By purchasing, downloading, installing, activating, or otherwise using any WordPress theme, plugin, or related digital product (each a “Product”) sold on the Site, you agree to be bound by this Agreement, our Terms of Service, our Privacy Policy, and our Refund Policy.
If you do not agree with any part of this Agreement, please do not purchase or use our Products.
1. Definitions
- “Product” – Any WordPress theme, plugin, or related digital item distributed by GetSmartWP, including its source code, bundled templates, images, fonts, scripts, styles, and documentation.
- “GPL” – The GNU General Public License version 2 or later, the same license under which WordPress itself is distributed.
- “License Key” – A unique alphanumeric credential issued to your Account that authenticates your Product installations with our update and support servers.
- “Paid Services” – Automatic Updates and Technical Support provided by GetSmartWP in connection with your purchase, as defined in Sections 5 and 6.
- “Activation” – The process of registering a Product installation (typically by site URL) with our update servers using your License Key.
- “Account” – Your registered user profile on https://getsmartwp.com.
- “Order” – A completed transaction that grants you a License under this Agreement.
2. Grant of License
2.1 Source-Code License (GPL)
All Products sold by GetSmartWP — including their PHP code, HTML templates, CSS, JavaScript, images, icons, fonts, and other bundled assets — are licensed to you under the GNU General Public License v2 or later (GPL).
Under the GPL, you are free to:
- Use the Product on any number of websites, for personal, commercial, or client work, with or without modification.
- Study and modify the Product’s source code to suit your needs.
- Distribute the original or modified source code to third parties, provided that:
- You preserve the original copyright notices.
- You distribute it under the same GPL license (or a GPL-compatible license).
- You clearly indicate any modifications you have made.
The full text of the GPL is included with every Product (typically in a LICENSE, LICENSE.txt, or license.txt file) and is incorporated by reference into this Agreement.
2.2 Paid-Services License
Separately from the GPL, when you place an Order you also receive a limited, personal, non-exclusive, non-transferable right to use our Paid Services — Automatic Updates and Technical Support — for the number of sites and the period specified in your Order (see Sections 3 and 5).
The Paid-Services License is granted only to the purchasing Account and is tied to your License Key. It does not transfer automatically with a copy of the Product distributed under the GPL.
3. License Tiers
Products may be offered in different License Tiers. Each tier defines the maximum number of License Key activations you are entitled to — that is, the maximum number of distinct sites (identified by site URL) on which your License Key may be registered with our update and support servers at the same time.
The exact tier details are shown on each Product’s sales page at the time of purchase.
Common tiers include, but are not limited to:

The number of activations in a tier may vary between Products and may change over time. The tier and its entitlements are fixed at the time of purchase and will be honored for that Order, even if we later change our tier structure.
3.1 Activation vs. Installation
It is important to understand the distinction between installation and activation:
- Installation — placing the Product’s source code on a website. Under the GPL (Section 2.1), you may install and use the Product on as many websites as you wish, with or without modification. We do not limit this.
- Activation — registering a specific site (by site URL) against your License Key so that it is recognized by our update and support servers. Activations are limited by your License Tier because they grant access to our proprietary Paid Services (Automatic Updates and Technical Support).
3.2 What Happens on Sites Beyond Your Activation Limit
If you install the Product on sites beyond your tier’s activation limit:
- Those extra sites can still use the Product under the GPL — we do not restrict that.
- Those extra sites will not receive Automatic Updates through our servers.
- Those extra sites are not eligible for Technical Support from us.
- You may not share a single License Key across extra sites by routing requests, cloning activations, or otherwise circumventing our activation checks.
If you need updates and support on more sites, you can upgrade to a higher tier at any time.
3.3 Managing Your Activations
You may deactivate a site from your License Key (for example, when you migrate to a new domain, close a staging environment, or retire a client site) and re-use that activation slot on a different site.
Current process (as of the Effective Date): A self-service activation dashboard is not yet available. For now, every deactivation is handled manually by our support team. To deactivate a site and free up an activation slot, please email hello@getsmartwp.com from your registered email address with: – Your Order ID or License Key – The site URL you want to deactivate – (Optional) The site URL you want to activate in its place We will process your request within 1–3 business days (Monday–Friday, excluding Indonesian public holidays). Once a self-service dashboard is available, this section will be updated and the manual-request step will no longer be required.
All environments count toward your activation limit, including production, staging, development, and local environments (such as localhost, .local, staging., dev., and .test). Every site URL that is activated against your License Key occupies one activation slot until it is deactivated.
3.4 Activation Change Limits
Because every deactivation currently requires a manual review by our support team (see Section 3.3), a fair-use limit applies to how often you may deactivate and re-use activation slots. This limit is meant to keep support capacity sustainable while we build our self-service tools.
- You may request up to five (5) activation changes per license slot per calendar year as part of normal use, without prior approval. An “activation change” means deactivating one site and activating a different site in the same slot.
- Activation changes that genuinely reflect your workflow — such as completing and handing over a client site, migrating to a new domain, or retiring an old install — are treated as normal use within this limit.
- Requests beyond this limit may be approved at our discretion if they are backed by a legitimate business reason (for example, running an agency that ships many client projects in a year). Please contact us at hello@getsmartwp.com to discuss an adjustment or a higher-tier upgrade.
- Rapid or repeated deactivate/reactivate requests that appear designed to circumvent the tier limit (e.g., cycling through many unrelated sites in a short period) may be declined, and in severe cases may lead to the temporary suspension of the affected License Key (see Section 4.3).
- Because activation changes are handled manually right now, we may decline requests that are submitted faster than we can reasonably process them.
These limits may be adjusted in the future — for example, relaxed once a self-service dashboard is launched, or tightened if abuse patterns require it. Any changes will apply prospectively and will not affect Orders already placed.
Important: Under the GPL, you may legally install and use a Product on as many websites as you wish. The tier limits and activation-change limits described in this Section 3 apply only to License Key activations, which control which sites are eligible to receive Automatic Updates and Technical Support through our servers.
4. License Key Usage
4.1 What a License Key Is
Your License Key is a personal access credential — similar to an API key or a password — that authenticates your requests to our update and support servers.
4.2 Your Responsibilities
You agree to:
- Keep your License Key confidential and treat it like a password.
- Not publish, share, sell, or otherwise disclose your License Key to any third party.
- Register your License Key only on sites that are within your tier’s allowed number of activations.
- Notify us at hello@getsmartwp.com immediately if you suspect your License Key has been compromised.
4.3 Our Rights
We may, at our sole discretion, deactivate or revoke a License Key if we reasonably believe it:
- Has been shared publicly, leaked, or distributed beyond your own use.
- Is being used to claim updates or support for more sites than the tier allows.
- Is associated with fraudulent payment, chargeback, or confirmed abuse of our services.
Deactivating a License Key does not revoke the GPL rights you have in the source code itself — it only ends your access to our Paid Services.
5. Duration of Paid Services
5.1 One-Year Term
Every License Tier includes access to Automatic Updates and Technical Support for one (1) year from the date of purchase (the “License Term”), unless explicitly stated otherwise on the Product’s sales page.
5.2 After Expiration
When the License Term expires:
- Your License Key will stop receiving new updates from our servers.
- Your License Key will no longer be eligible for Technical Support.
- You may continue using the last version of the Product you have under the GPL, indefinitely, at your own discretion and risk.
- You will not automatically receive security patches; installing security-relevant updates after expiration requires renewal.
5.3 Renewal
- Renewals extend the License Term for another one (1) year, starting from the renewal date (or from the prior expiration date, depending on our billing system’s configuration at the time).
- Renewal pricing may differ from the original purchase price and will be clearly displayed before you complete the renewal.
- Renewal fees are non-refundable once processed (see our Refund Policy).
- If we stop offering a particular Product, active licenses for that Product will continue to receive updates and support through the end of their current term where reasonably possible, but renewal may not be available.
6. Automatic Updates and Technical Support
6.1 Automatic Updates
During the License Term, you may receive:
- Bug fixes and stability improvements.
- Security patches.
- Feature enhancements and compatibility updates (e.g., for new WordPress or PHP versions).
Updates are delivered through our update servers to sites where your License Key has been activated.
6.2 Technical Support
Technical Support is provided through the channels listed in our Terms of Service (e.g., email, contact form, documentation, and — when available — the ticket system and YouTube channel).
Support covers:
- Installation and activation issues
- Bug reports and defect fixes
- Basic usage questions about documented features
Support does not cover:
- Custom development, design, or bespoke feature requests
- Conflicts with third-party plugins, themes, or custom code
- Server-level debugging, hosting configuration, or DNS
- Modifications you have made to the Product’s source code
- Training on WordPress, PHP, CSS, JavaScript, or general web development
Support response times are best-effort; we aim to respond within 1–3 business days (Monday–Friday, excluding Indonesian public holidays).
7. Ownership and Intellectual Property
7.1 Copyright in the Source Code
Copyright in the Product’s source code remains with GetSmartWP or its respective contributors. Your right to use, modify, and redistribute the source code is governed by the GPL (Section 2.1).
7.2 Trademarks
The “GetSmartWP” name, logo, product names, slogans, visual identity, and all other brand assets are trademarks of GetSmartWP, whether registered or not. Trademark rights are separate from copyright and are not waived by the GPL.
You may NOT:
- Use the GetSmartWP name, logo, or any confusingly similar mark to promote, sell, or distribute any product or service.
- Re-brand, rename, or “white-label” our Products using our original name or branding in a way that suggests an official release.
- Imply affiliation, sponsorship, partnership, or endorsement by GetSmartWP without our prior written consent.
- Use our brand in domain names, social media handles, app names, or marketplace listings in a manner that causes confusion with our official presence.
If you redistribute a modified copy of a Product under the GPL, you must remove or change the GetSmartWP name, logo, and branding before distribution.
7.3 Prohibited Conduct Regarding Paid Services
While the source code is freely redistributable under the GPL, the Paid Services (Automatic Updates, Technical Support, License Keys, customer dashboard, update servers) are our proprietary services. You may NOT:
- Share, resell, or sublicense your License Key.
- Claim to provide “official updates” or “official support” for GetSmartWP Products.
- Use automated tools to scrape, mirror, or republish our update servers, download endpoints, or customer dashboard.
- Bypass, disable, or circumvent any License Key validation mechanism that we have implemented in good faith.
Violation of this Section 7 may result in immediate suspension of your License Key and Account, without affecting the GPL rights you retain in the source code.
8. Warranty Disclaimer
To the maximum extent permitted by applicable law:
- The Product and Paid Services are provided “AS IS” and “AS AVAILABLE”, without warranty of any kind, whether express, implied, statutory, or otherwise.
- We disclaim all warranties of merchantability, fitness for a particular purpose, non-infringement, and error-free or uninterrupted operation.
- We do not warrant that the Product will meet your requirements, be compatible with every WordPress version, hosting environment, or third-party plugin/theme, or be free from bugs or security vulnerabilities.
- You are responsible for maintaining adequate backups of your website and for testing updates in a staging environment when appropriate.
This disclaimer is consistent with, and supplementary to, the warranty disclaimer contained in the GPL.
9. Limitation of Liability
To the maximum extent permitted by law:
- GetSmartWP and its affiliates, employees, contractors, and agents shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to loss of profits, revenue, data, goodwill, or business opportunities, arising out of or in connection with the Product, the Paid Services, or this Agreement.
- Our total aggregate liability to you for any claim arising out of or in connection with this Agreement shall not exceed the amount you actually paid to GetSmartWP for the specific Product giving rise to the claim in the twelve (12) months preceding the event that gave rise to the claim.
Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you to the extent prohibited by applicable law.
10. Termination
10.1 Termination by You
You may terminate this Agreement at any time by:
- Uninstalling the Product from all your websites; and
- Deleting all copies of the Product in your possession.
Termination does not entitle you to a refund except as provided in our Refund Policy.
10.2 Termination by Us
We may suspend or terminate your License Key and Paid Services (but not the GPL rights you have in the source code itself) if you:
- Materially breach this Agreement, our Terms of Service, or the Refund Policy.
- Misuse our trademarks or brand.
- Share, publish, or resell your License Key.
- Initiate a chargeback or payment dispute in bad faith.
- Engage in fraudulent, abusive, or illegal conduct in connection with the Product or our Site.
10.3 Effect of Refund
If your Order is refunded (whether under our 14-Day Money-Back Guarantee or otherwise):
- Your License Key will be deactivated immediately.
- You will lose access to Paid Services for that Product.
- You are asked, in good faith, to uninstall and remove the Product from all installations.
- You may not use our name, logo, or brand to present the refunded Product as “official”.
10.4 Survival
Sections related to Ownership and Intellectual Property (7), Warranty Disclaimer (8), Limitation of Liability (9), Governing Law (12), and any other provision that by its nature should survive, shall survive any termination of this Agreement.
11. Third-Party Components
Some Products may include or depend on third-party libraries, frameworks, icons, fonts, or other components that are licensed separately from this Agreement (for example, under MIT, Apache 2.0, SIL OFL, or other licenses). Those third-party components remain governed by their own licenses, which are included in the Product where applicable.
You are responsible for complying with any third-party license terms that apply to your use of the Product.
12. Governing Law and Dispute Resolution
12.1 Governing Law
This Agreement is governed by and construed in accordance with the laws of the Republic of Indonesia, without regard to its conflict-of-law principles, and without prejudice to the GPL, which is governed by its own terms.
12.2 Dispute Resolution
In the event of any dispute arising out of or in connection with this Agreement:
- Informal Resolution – Please first contact us at hello@getsmartwp.com so we can try to resolve the matter amicably.
- Mediation/Arbitration – If informal resolution fails, disputes shall be resolved through mediation or arbitration in West Java, Indonesia, unless otherwise required by applicable consumer protection laws in your jurisdiction.
- Court – Any remaining disputes shall be submitted to the exclusive jurisdiction of the competent courts located in West Java, Indonesia.
12.3 Consumer Rights
Nothing in this Agreement limits any non-waivable statutory rights you may have as a consumer under the laws of your country of residence.
13. Changes to This Agreement
We may update this Agreement from time to time. The “Last Updated” date at the top of this page will reflect the most recent revision. Material changes will be communicated via email or a notice on our Site.
- Changes apply prospectively — they do not retroactively affect Orders already placed under a previous version of this Agreement.
- Your continued use of the Product or Paid Services after an update takes effect constitutes acceptance of the updated Agreement.
14. Miscellaneous
14.1 Entire Agreement
This Agreement, together with our Terms of Service, Privacy Policy, Refund Policy, and the GPL, constitutes the entire agreement between you and GetSmartWP regarding the licensing of our Products, and supersedes any prior agreements.
14.2 Severability
If any provision of this Agreement is found to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.
14.3 No Waiver
Our failure to enforce any provision of this Agreement shall not be deemed a waiver of our right to enforce it later.
14.4 Assignment
You may not assign or transfer this Agreement, or any rights or obligations under it, without our prior written consent. We may assign this Agreement freely, including in connection with a merger, acquisition, or sale of assets.
